Rav Badani: The judgement against Rav Berland is nonsense!
RAV SHIMON BADANI: IT'S ALL A JOKE! Rav Shimon Badani is a leading Sfardi posek in Israel, appointed by Rav Ovadia Yosef, a leader of the "Gedolei Mo'etzet Hatorah", Rav Ovadia's Council of Rabbis and Torah Scholars of Shas. Following on from Rav Shimon Badani's recent visit to Rav Eliezer Berland, Rav Badani, shlita, said a few words afterwords about the people persecuting the Rav, and the tactics they used to try to build a 'case' out of thin air. [I said to them]ā āWhat are you saying? We need to hold a Beit Din!ā [They told me]: āWe made ourselves a Beit Din, already.ā [I replied]: āAh, youāve held a Beit Din already? Wonderful. What did you decide?ā ā[They told me]: āThe girls [who were meant to have made the complaints] were brought to these people [i.e. the persecutorsā own Beit Din].ā [I responded]: āAh, did you also bring [Rav Berland] there too?ā [They replied]: āNo!āā Rav Badani continues: āHow can this be?! How can you judge someone when heās not even there [to defend himself]?! This is a sin.[They told me] Ā He is gavra alma- āa dangerous personā[1]. What sort of ādangerous personā is this?! Heās a physically unwell man aged 80 years old. And this is a gavra alma?! > āWhat youāre telling me is nonsense. Thereās no such thing as this. āAfterwards I said them you, you see, now heās come out [of prison]. Go to the Beit Din of the Eida Chareidit, and let them judge the case.Ā They didnāt go. They left. Everything is nonsense! āI heard from a clerk what happened, they asked me about everything. I adjudged everything. Whatever they [i.e. the Ravās persecutors] are going to try to do to me, they arenāt going to be able to do it. I already told them my opinion, that they should go to a Beit Din, so they shouldnāt get their brains all confused. [I said] Why are you coming to me?! āYes, I told them. Who appointed you? Breslov Rabbis? Who appointed you? Ok, letās suppose thatās true [that they were really appointed by Breslov rabbis]. Why didnāt you invite him [Rav Berland] to attend [the hearings]? [They told me] > He is a gavra alma ā a ādangerous manā. RAV BADANI CONTINUED TO TELL RAV BERLANDāS PERSECUTORS: āWho are you?! You are the judges and also the deciders? You are saying he is gavra alma. All of this is [coming from] you! Who gave you the right to do this? Gavra alma, gavra alma. What are you talking about, gavra alma?! āI go according to the Shulchan Aruch, and according to the Torah. I donāt go according to my āgut feelingā. What sort of ārabbiā is this man (i.e. the Ravās persecutor). What sort of ārabbiā is he? If there is no Beit Din, then there is nothing. Itās all nonsense. āEven though the Gemara states that: āif there is a voice against him heās suspected"[2], this only applies in a case where there are no enemies. So what do you want? All of you hate him (i.e. Rav Berland)! Hashem will help us.ā == ALL PATHS LEAD BACK TO THE SAME PEOPLE Rav Shimon Badaniās words make clear that the Ravās persecutors created the āsmokeā to blacken his name; then they created a false āBeis Dinā to judge him; then they claimed that because there is āsmokeā there must be fire, and handed down a false psak against him without even inviting Rav Berland to the Beit Din to defend himself. And then, they took this false ājudgmentā to other poskim and rabbis, to try to get them to rubber-stamp the decision of the false Beit Din. AND IN THE MEANTIME, ITāS THE SAME PEOPLE BEHIND IT ALL! The same people created the false tapes, the same people created the false allegations, the same people fabricated the false claims on Facebook and in TV and newspaper interviews. But they didnāt take any of this āevidenceā to a Beit Din, an accepted halachic authority. They claimed to have judged it properly themselves, then took it to a secular court which had a big vested interest in exonerating a police investigation that cost 10 million shekels and involved diplomatic interventions in three foreign countries. As Rav Badani concluded, Hashem yāazor ā God will help us, and the truth will finally come out. [1]Ā Gavra Alma is a halachic term that applies in rare cases when someone is a known murderer. Then, aĀ Beit Din will be afraid to bring him to court as he might take peopleās lives if heās apprehended. So in those cases, they are allowed to judge and hold the court case without the defendant being there. [2] This is another halachic concept that was abused by Rav Berlandās persecutors, which means something akin to āthere is no smoke without fireā. But, this only applies to a known criminal who sins in public, and thatās when the āno smoke without fireā principle is taken into account by the judges in a Beit Din, because there is probably some truth behind it. However, this same halacha continues that this principle can only be applied where the people making the accusations arenāt āenemiesā or haters of the person they are accusing with the āno smoke without fireā principle.
